General Terms of Sale
1. Purpose and acceptance
This English version is provided for information only. The French version (vintradex.com/fr/legal) is the authoritative legal version and shall prevail in case of any discrepancy.
These General Terms of Sale (T&Cs of Sale) govern any commercial transaction carried out on the Vintradex platform (vintradex.com), operated by Djadane Mohammed EI, SIREN 101 027 220 (hereinafter "Vintradex").
Any order or listing on Vintradex implies full and unreserved acceptance of these T&Cs of Sale by the Buyer and the Seller. Vintradex reserves the right to modify the T&Cs of Sale at any time; the applicable version is the one in force on the date of the transaction.
2. Status of participants
Vintradex is a platform that connects sellers (private individuals, professionals "PROs" and the Platform itself for its Vault service) with buyers of collectible items (cards, watches, art, vinyl records, comics, figurines, coins, stamps, etc.).
Unless otherwise specified (see Article 7 "Vault"), Vintradex acts as a technical intermediary within the meaning of article 6 of the LCEN, and is not a party to the sales contract concluded between the Buyer and the Seller.
Individual Seller (private seller): adult natural person, non-professional, selling their personal second-hand goods.
PRO Seller: natural or legal person having provided the required supporting documents (KYC: ID card, KBIS, SIRET, proof of address, VAT compliance) and validated by Vintradex after review within 24-72 business hours.
3. Prices, payment and invoicing
Prices are displayed in euros (EUR), inclusive of all taxes. Each Seller freely sets the price of their item and includes therein, where applicable, the VAT for which they are liable under their own tax regime (basic exemption, standard regime, margin scheme, etc.). Vintradex does not calculate, collect or remit any VAT on behalf of Sellers and issues no VAT invoice in their name: compliance with VAT obligations (declaration, invoicing, legal mention) rests exclusively with each Seller, particularly professionals. The summary issued by Vintradex is an order receipt, not a tax invoice.
Vintradex, for its part, benefits from the VAT exemption regime (Art. 293 B of the CGI): no VAT is invoiced by Vintradex on its commissions or fees.
At payment, the Buyer pays, in addition to the item price set by the Seller: (a) a Vintradex commission of 12% of the item price, applicable to all sales (marketplace, Vault and live Drops); (b) payment fees for secure bank processing (approximately 1.5% + €0.27, indicative); (c) shipping costs according to the chosen method. The exact total amount is calculated and displayed by Vintradex before any payment, and it is that amount which is charged.
Payments are processed by Stripe Payments Europe, Limited (Ireland) — see their own terms at stripe.com. Vintradex does not collect, store or process any payment card data.
Payment is due immediately upon ordering. In the absence of actual payment, the order is automatically cancelled and the items are relisted for sale.
4. Order and conclusion of the contract
The order becomes firm and final after payment confirmation by Stripe (payment_intent.succeeded event). A summary email is sent to the Buyer.
Vintradex reserves the right to refuse or cancel any order presenting a clear risk of fraud, money laundering, or in the event of payment default, without any compensation to the Buyer.
5. Delivery — the three methods
Three delivery methods are offered at the Buyer's choice, when enabled by the Seller for the relevant listing:
🏛 Vintradex Vault — the item remains stored and held by Vintradex (see Article 7). No physical shipment: the Buyer may keep it in the Vault, resell it without taking it out, or request its later withdrawal (Mondial Relay costs then borne by the person withdrawing).
📦 Mondial Relay shipment — Vintradex provides a prepaid label; the Seller drops off the parcel at a pickup point. Indicative timeframe 3 to 5 business days. Countries served via pickup point: France, Belgium, Luxembourg, Netherlands, Spain, Portugal, Italy, Poland. Countries served via home delivery: France, Belgium, Luxembourg, Germany, Spain, Portugal (Germany is served via home delivery only). The list of countries and modes actually available is the one displayed at checkout, which prevails should the carrier's coverage evolve.
🤝 In-person handover — direct physical handover between the parties, at an agreed place and time (shop or listed Spot).
Transfer of risk: the risk of loss or damage is transferred to the Buyer upon handover to the Mondial Relay carrier or upon in-person handover, except for specific carrier warranty. For items kept in the Vault, the regime of Article 7 applies. Vintradex never acts as a carrier.
5 bis. Escrow of funds (graduated escrow)
To secure transactions, Vintradex applies a graduated escrow mechanism that differs according to the Seller's status:
Sale by an individual Seller — the price paid by the Buyer is held in escrow by Vintradex, acting as a trusted third party, and is released to the Seller only after objective confirmation of delivery: actual receipt at the Mondial Relay pickup point, or scanning of the in-person handover QR code (token valid for 30 minutes, anti-replay). The Buyer protection period is 7 calendar days from payment: at the end of this period, the funds are released to the Seller where delivery is confirmed, or refunded to the Buyer in the event of established non-delivery.
Sale by a PRO Seller or by Vintradex (own stock) — no escrow is applied: payment is acquired by the Seller upon confirmation of payment by Stripe, these sellers being either previously identified (PRO KYC) or being Vintradex itself.
Exception — items already in the Vault: when the sold item is already deposited in the Vintradex Vault and was checked as conforming upon entry, the Seller, even an individual, has fulfilled their delivery obligation as of that deposit. Their payment is therefore acquired upon confirmation of payment, without escrow, whether the Buyer chooses to keep the item in the Vault or to request its forwarding via Mondial Relay. Any forwarding is a matter of Vintradex's logistics alone, as custodian of the item, and the corresponding transport risk does not fall on the Seller.
Escrow is a payment-security and Buyer-protection device. It grants Vintradex no role as arbiter, expert or guarantor of the quality, conformity or authenticity of the item, which fall exclusively to the Seller (see Articles 9 and 11). Release of funds upon occurrence of the objective condition (confirmed delivery) does not amount to recognition by Vintradex of the item's conformity.
6. Right of withdrawal
In accordance with articles L.221-18 to L.221-28 of the French Consumer Code, the consumer Buyer has a period of fourteen (14) calendar days from receipt of the goods to exercise their right of withdrawal with a PRO Seller, without having to justify the decision.
This right does NOT apply to sales between individuals (non-professional seller), nor to goods made to the consumer's specifications (engraved, personalised items), nor to public auctions (live Drops).
The right of withdrawal is exercised by written notification (email: contact@vintradex.com) accompanied by the standard withdrawal form. Return costs are borne by the Buyer except in cases of proven defect.
7. Vault service — custody, deposit and traceability
When an item is deposited in the Vintradex Vault, Vintradex acts as a custody service provider. Vintradex is not the owner of the item; it is only the precarious holder within the meaning of articles 1915 et seq. of the French Civil Code.
An item may only be listed for sale "in the Vault" if it is already physically present there: there is no sale "in the Vault" of an item that has remained with the Seller. The Vault admits three entry routes: (1) deposit by a Seller, individual or professional: the Seller sends their item(s) to the Vault via Mondial Relay, where applicable grouped into a single parcel (from one to fifteen items from the same sender, a single label, a single payment), before any listing. Upon receipt, Vintradex performs a visual conformity check (match between description / photos / actual item); the item is listed for sale only once that check is validated. The Seller, individual or PRO, remains solely responsible for the conformity, authenticity and lawfulness of their items; (2) direct stocking by Vintradex of its own items; (3) buy-and-leave, where a Buyer purchases an item and chooses to leave it in the Vault.
Reference and provenance: each item in the Vault receives a short internal reference (e.g. "A07") and a provenance record tracing its operations (entry, listings, resales, exit) within an internal ledger with tamper-evident, append-only logging. This traceability is an internal tracking and transparency tool; it constitutes neither a certification of authenticity, nor an appraisal, nor a guarantee of value, and cannot replace a third-party certifier (PSA, BGS, CGC, WATA, etc.).
Resale without taking out: an item kept in the Vault may be relisted and resold without physically leaving it. Ownership then transfers between the Seller and the new Buyer, the item remaining in Vintradex's custody. Each operation remains subject to the warranty cap defined below, regardless of the number of successive resales.
Vault pricing: Seller's shipment to the Vault: actual Mondial Relay price (according to weight, €4.95 to €18.50 incl. tax) + payment fees (bank processing, approximately 1.5% + €0.27). No Vintradex commission on this shipment (the 12% commission applies only to the sale). Custody: 1st month free, then a monthly fee proportional to the item's value — computed on the higher of the value declared by the depositor or the listing price — displayed in the interface at deposit and at any time in the Vault area. To avoid charging negligible amounts, custody fees accumulate and are only charged once the holder's cumulative balance reaches €10 incl. tax; the counter carries over from one month to the next until that threshold. The monthly grouped shipment of Vintradex stock items is free. Withdrawal from the Vault via Mondial Relay is borne by the person withdrawing.
Item non-conform on deposit: if, during the conformity check, an item deposited by an individual Seller does not match its description (condition, authenticity, lawfulness), Vintradex rejects it. No refund of the initial shipping fees is due. The depositor then has two options: (i) recover the item, the Mondial Relay return shipping being at their expense; or (ii) abandon the item, which becomes the full property of Vintradex, which may keep, transfer, recycle or destroy it. Failing a choice within thirty (30) days of the rejection notice, the item is deemed abandoned to Vintradex.
Vintradex disclaims any liability in the event of force majeure, natural disaster, fire, burglary (except in case of proven negligence), or damage attributable to an inherent defect of the item (paper acidity, natural oxidation, etc.).
The value declared by the Seller upon deposit is for information only; it does not bind Vintradex beyond the warranty cap of €1,000 excluding tax per item, except if a complementary insurance is taken out at the Seller's expense.
The depositor warrants that the entrusted item is in their full ownership, free from any encumbrance or dispute, and that it is not an illegally obtained, counterfeit, or theft-reported good. For any deposit in the Vault, whether by an individual or a professional, this warranty rests entirely with the depositor; the conformity check performed by Vintradex upon receipt is a visual matching check which transfers no liability to Vintradex and amounts neither to an expert appraisal nor to authentication.
8. PRO Drops — live sales
Drops are live sales organised by validated PRO Sellers. This feature is being prepared and will be enabled later; these terms will apply as soon as it opens.
When active: no fixed fee is charged to the PRO Seller to organise a Drop. As on the regular marketplace, Vintradex charges a 12% commission on each sale made during the Drop, plus payment fees (approximately 1.5% + €0.27), borne by the Buyer.
Sales made during a Drop are concluded between the Buyer and the PRO Seller; the general rules of sale between a professional and a consumer apply, including the 14-day right of withdrawal for delivered goods. If a scheduled Drop is cancelled by the PRO Seller, any order already paid is fully refunded to the Buyer.
9. Warranties and conformity
PRO Seller: the Buyer benefits from the statutory warranty of conformity (art. L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (art. 1641 et seq. of the French Civil Code). The PRO is liable for non-apparent defects and for the conformity of the good with its description.
Individual Seller: only the warranty against hidden defects applies (art. 1641 of the French Civil Code). No statutory warranty of conformity is owed by a non-professional seller.
Authenticity: Vintradex is not an expert and does not authenticate items. Any certifications displayed (PSA, BGS, Beckett, CGC, WATA) are those provided by the Seller; Vintradex performs a visual conformity check (matching description/photos/actual item) upon Vault deposits, which cannot be equated with authenticity certification. The Buyer must contact the Seller or a third-party expert directly for any authenticity dispute.
Certificate number verification: for items declared as PSA-graded, Vintradex automatically queries PSA's public registry (psacard.com) to verify that the declared certificate number exists; a listing whose number is unknown to that registry is refused for publication. This check relates exclusively to the number and the registry's public data: it constitutes neither an authentication of the physical item, nor a guarantee that the item presented actually matches the certificate, nor any commitment by Vintradex as to the item's condition or value. Any "certificate verified" mention must be understood in this strict sense.
9 bis. Catalogue, market indexes and market data
The Platform provides a reference catalogue (cards and collectibles) as well as "market indexes", for purely informational and indicative purposes. These indexes result from the aggregation of public market data from third-party sources and from the history of sales completed on the Platform; data expressed in foreign currencies is converted into euros at the official reference rate published by the European Central Bank.
Market indexes constitute neither an offer, nor an expert appraisal, nor a guarantee of value, liquidity or price evolution, nor investment advice. Vintradex guarantees neither the accuracy, nor the completeness, nor the currency of this data, and disclaims all liability for purchase, sale or holding decisions made on its basis. The value of collectibles may vary significantly, upwards as well as downwards.
The visuals, card names, game names, logos and other distinctive signs presented in the catalogue belong to their respective publishers and rights holders. They are reproduced for the exclusive purpose of identifying the products offered for sale (necessary referential use). Vintradex is not affiliated with any of these publishers and is neither sponsored nor endorsed by them. Any rights holder may request the removal of a visual or a record by writing to contact@vintradex.com — such requests are handled with priority, within seven (7) business days.
10. Disputes and mediation
In the event of a dispute, the Buyer must first contact the Seller via Vintradex messaging, then Vintradex (contact@vintradex.com), which may open an internal mediation procedure.
In accordance with article L.612-1 of the French Consumer Code, the Consumer may use a consumer mediator free of charge. Vintradex designates as the competent mediator: Centre de Médiation et d'Arbitrage de Paris (CMAP), 39 avenue Franklin D. Roosevelt, 75008 Paris (www.cmap.fr). The mediator may only be contacted after a prior written claim has been addressed to Vintradex and has not received a satisfactory response within 2 months.

Failing amicable resolution, the competent French courts shall have sole jurisdiction, notwithstanding multiple defendants or warranty claims.
11. Limitation of liability
Vintradex cannot be held liable for indirect damages (loss of business, loss of opportunity, reputational harm), for the acts of third-party Sellers, for malfunctions attributable to providers (Stripe, Mondial Relay, Infomaniak, LiveKit), or for cases of force majeure (massive cyber attacks, telecom outages, natural disasters).
Vintradex's total contractual liability to a Buyer or Seller is in any event capped at the total amount paid by that person on the platform during the 12 months preceding the damaging event, except for proven gross negligence or wilful misconduct.
Vintradex is not responsible for the content of listings published by Sellers (descriptions, photos, prices); it nevertheless reserves the right to moderate or remove any listing that does not comply with the Terms of Use.
12. Applicable law and jurisdiction
These T&Cs of Sale are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent French courts, after a mandatory prior attempt at mediation (see Article 10).
