Terms of Use

1. Acceptance

This English version is provided for information only. The French version (vintradex.com/fr/legal) is the authoritative legal version and shall prevail in case of any discrepancy.

Use of the vintradex.com website and its services (hereinafter "the Platform") implies unreserved acceptance of these Terms of Use. Failing acceptance, the user may not access the Platform.

The Terms of Use may change; each modification is notified by a banner on the site. Continued use after publication of a new version constitutes acceptance.

2. Account creation and identification

Registration is free and open to any legally capable adult natural person, or to a duly represented legal entity. The user warrants the accuracy and truthfulness of all information provided during registration.

The account is strictly personal and non-transferable. The user undertakes to keep their credentials confidential and to protect them with a strong password (16 characters minimum recommended, mix of uppercase, lowercase, digits, symbols). Enabling two-factor authentication (2FA TOTP) is strongly recommended.

Any connection or operation carried out with a user's credentials is deemed to originate from that user. In case of suspected compromise, the user must immediately reset their password and report the incident to: contact@vintradex.com.

3. PRO status and KYC

Access to PRO Seller status is conditional upon the provision and validation of the following supporting documents: ID document (national ID, passport or residence permit) front/back, KBIS extract less than 3 months old, professional address proof less than 3 months old, SIRET, intra-community VAT number where applicable, company bank details (RIB) for Stripe Connect payouts.

Vintradex reserves a discretionary right to accept or refuse PRO applications, without obligation to justify, in compliance with the principle of non-discrimination. Any identified fraudster will be reported to the competent authority (TRACFIN, art. L.561-15 of the French Monetary and Financial Code).

Documents provided under KYC are kept in a secure separate file for 5 years after the last transaction, in accordance with anti-money laundering and counter-terrorist financing (LCB-FT) obligations, and then destroyed.

4. Prohibited behaviours and content

The following are strictly prohibited on the Platform, without this list being exhaustive: (a) the sale of counterfeit, stolen, illegal or regulated goods (weapons, drugs, protected species, etc.); (b) any practice of money laundering, tax fraud, or capital evasion; (c) the dissemination of hateful, racist, unsolicited sexual, or defamatory content; (d) any attempt at phishing, hacking, or mass data extraction from the site; (e) the creation of multiple accounts to circumvent a sanction; (f) directly soliciting users to carry out transactions off-platform in order to bypass commissions.

Any breach entails, depending on severity, a warning, temporary suspension or permanent termination of the account, without notice or compensation, and without prejudice to civil and criminal proceedings.

5. Moderation and reporting

Vintradex moderates listings, chat messages, profiles and photos after publication when reported or automatically detected. Any user can report manifestly illegal content or content contrary to the Terms of Use via the report button present on each resource or by email to contact@vintradex.com.

Vintradex undertakes to examine any report within a reasonable time (generally 24-72 business hours). Manifestly illegal content is removed without notice; the affected users are informed.

Vintradex maintains a register of moderation actions (audit log) kept for 6 months, in accordance with DSA obligations (EU Regulation 2022/2065).

6. Ownership of user content

The user retains full ownership of their content (listings, photos, descriptions, messages). They grant Vintradex, free of charge, a non-exclusive licence to use, reproduce, represent and adapt this content, solely for the purposes of operating and promoting the Platform, for the entire duration of use of the service and for 1 year after account deletion (duration necessary for legal archiving).

The user warrants that they hold all necessary rights over the content they publish (in particular photographic rights), and shall indemnify Vintradex against any third-party claim in this regard.

7. Availability of the service

Vintradex endeavours to ensure the availability of the Platform 24/7, subject to scheduled maintenance operations (notified in advance where possible) and cases of force majeure. No guarantee of absolute availability is given, and Vintradex shall not be liable for damages resulting from a temporary unavailability.

Vintradex reserves the right to interrupt, suspend or modify all or part of the services at any time, without notice or compensation, in particular for security or maintenance reasons, or in the event of cessation of activity.

8. Termination

The user may terminate their account at any time from their dashboard (Settings section → Delete my account). Deletion is effective within 30 days, during which a reactivation request is still possible. Beyond that, personal data is deleted or anonymised (see Privacy Policy), with the exception of data subject to legal retention obligations (LCB-FT, accounting).

Vintradex may terminate or suspend any account in case of breach of the Terms of Use / T&Cs of Sale, proven fraud, or any legitimate reason, after written notification that has remained without effect (except in cases of urgency or seriousness justifying immediate action).

9. Cybersecurity — user duties

The user acknowledges that the security of their account largely depends on their own vigilance: strong and unique password, 2FA TOTP enabled, never click on links in unsolicited emails purporting to be from Vintradex (always check the vintradex.com domain), never share validation codes, immediately report any suspicious activity.

Vintradex implements security measures in line with the state of the art (mandatory HTTPS, Argon2id password hashing, detection of compromised passwords via HIBP, Cloudflare Turnstile anti-bot verification, login logging, anomaly alerts). No measure can however be absolute.

10. Applicable law

These Terms of Use are governed by French law. The French courts have sole jurisdiction for any dispute.
